What is Tort & Compensation
According to 914 CC, if someone hurts someone else unlawfully and intentionally, he/she is obliged to compensate him/her.
If the legal obligation to act in a certain way stems from an agreement, both contractual and tortuous responsibilities may coincide.
However, the incompliance by one of the signatories of a certain obligation as per a certain agreement may lead to the founding of compensation by tort, according to art. 919 CC, given that it is against accepted principles of morality, even if it had not taken place within the framework of an in-advance agreement in place.
